stealing my music

i sent a fellow electronic muscian a hip hoppy loop i was working on about a year and a half ago. im listening to mp3s of his new album and i notice my loop is now one of his songs. i read a review and it said that he 'really is trying something different' with said track and it 'sounds different from everything else on the albm' and of course it does because its mine. my question is:
A) how come god is so cruel that he would let other people get famous off my work? and
B) how do i get a record deal?

ps: dont ask me who it is please.

he sampled you basically - how did you produce the loop? if its based on samples which you then treated and edited yourself then thats laziness and disrespectful on the other guy's part for sure, but i'm not there's much you can do about it apart from cross him off your greetings card list dude :(

It's a tough one to call. In some ways you could just say he was sampling you like he'd sample anything else.

However, if he's not giving you any credence for it (especially as he's grabbed something unreleased) it can be incredibly annoying and rude. I imagine the bloody cheek of it is pissing you off far more than the act itself.

A lot of it depends on how close your relationship is with him. If he's a good friend then all it probably needs is a friendly chat where the phrases "publishing" and "stop talking shit in interviews" feature heavily.

If he's not so much a good friend, find out who is publishing company is, give them a call and see who is getting the credit for the track. If you're not mentionewd anywhere then phone either his label or his management and tell them what's happened in a nice semi-aggressive voice and tell them (quite rightly) that you could have the album taken off the shelves for a long time while it all gets worked out.

Try the friendly approach first, if it doesn't work then remember you have got all the power in this. Threaten legal measures, it'll probably shock everyone involved into capitulation. Unless the guy has taken pre-emptive steps in making sure you're not going to be able to do anything about it then you are in the legal right and can cause (or threaten to cause until you get your credit) havoc.

I like the moldy cheese idea. Make sure it's runny as well.

Ned Raggett (Ned), Friday, 14 March 2003 14:20 (twenty-three years ago)

why waste the good cheese?

Hey, I'm admitted to the California bar. You could kill 2 birds with one stone (publicity and ch$-ching) by suing him, but I'd approach him nicely and ask for a credit/point first.

Fuck his girlfriend & his friend's girlfriends. Then they'll hate him.

David R. (popshots75`), Friday, 14 March 2003 19:53 (twenty-three years ago)

Oh you are so ripe for an unauthorized sample hold-up (a time-honored hip-hop tradition, although it's kind of uncool). There are half a dozen music lawyers in LA who would take your case on contingency, email me if you want.

felicity (felicity), Friday, 14 March 2003 20:44 (twenty-three years ago)

Chris Piuma's post reminds me of a joke.

Lawyer 1 and Lawyer 2 are walking across a bridge. A beautiful woman walks by them in the other direction.

Lawyer 1: "Man, I'd really like to screw her."
Lawyer 2: "Really? Out of what?"

felicity (felicity), Friday, 14 March 2003 20:47 (twenty-three years ago)

That's a good one, but I'm always afraid to relay lawyer jokes to my lawyer friends. I mean, surely they've heard them all?
