I just got defrauded out of 350 quid

Someone bounced a cheque on me. Annoyingly, I had the guy's phone number, but I threw it out a coupla days ago. It wasn't a "refer to drawer", it was a "stopped by account holder" bounce. I'm about to call thee cops and ask for advice, but I fear I'm going to have to basically eat it. What a way to start the day. I am very pissed off.

You can get your bank to track him down through the cheque. I've done this before.

What Ed said. What was it for? If iot was services rendered and there are invoices or agreements involved (e-mails, contracts) then you can batter him with the small claims court.

It was for a [er....ahem] I was selling on behalf of another customer. I called the bank, and I have to write them a letter explaining the situation. The only possibility the person at the bank was able to come up with was that the person had their cheque book stolen, and they called to pull the cheque book - this seems unlikely to me though. Our bank, and the person's bank is the same one, tho' I don't know if this will help.

I think you have a pretty good claim, banks don't like bouncing cheques and frown upon customers who do. If you have a legal sale (which you have) then it should not be too hard to chase this up. Unless they are bankrupt (not just morally).

I called the police, and asked for advice. I have to go through the bank procedure, and get back in touch if that proves fruitless. I have a incident number to refer to, if this proves to be the case. I spent time that would be better spent repairing bikes (I have a load in to do) writing to the bank as well. We shall see what happens. The person who gave me the cheque has had his bikes repaired by us on several occasions in the past, and has been no trouble, so I thought I cd trust him! I know, I'm naive.... I can't think of any good reason why he would stop the cheque though. Worse still, the people who I was selling the tandem for will be coming back to the UK soon, so I'll have to give them the money! That's going to hurt.

Not necessarily - you can pass the proceedings on to them since you were just a selling agent. However this is down to you with regards to your business...

That is something I would not do. (passing the proceedings on, that is) IMO, to remain personally ethical, I have to pay them the money.

No, I understand that and thought that would be the case. But if it was a matter that was going to jeapordise the business then it is an option you could consider. Though when you hear from the bank and have a better idea about the length of time for the proceedings this is information worth sharing with them so they know what a bind you are in. They will appreciate your honesty even more then.

Well, February has been an unusually good month, so it isn't jeapordising the business, fortunately (is that how you spell jeapordise? It doesn't look right.) What I'll do is I'll tell them and if they say, oh dear, we can wait, then I'll do that, but to be honest, I'd rather give them their money. Actually, I'll most likely give them the money regardless. I was really pleased when I sold a Birdy Grey, which is a very high-quality & expensive German folding bicycle last month. It cost 1650 uk pounds. Guess how much of that is profit, after you take the VAT off? I hope this guy comes in & redeems the cheque, that's all. (BTW I knew that's what you meant Pete)

two weeks pass...
his wife came in to-day, because they had broken a bit of it. she asked to buy a tool to fix the broken part. i was very polite and asked her to get her husband to redeem the bounced cheque. she seemed genuinely horrified, and pulled out 350 pounds ca$h and paid me. Apparently, he hadn't filled in the cheque stub, and panicked, thinking hed had a cheque nicked. that seems a bit feeble, I know, but she was obviously sincere, so I think it's true. what a relief! You can perhaps imagine that I was hopping about w/adrenaline for the rest of the afternoon.

You wouldn't believe it actually....people come in - "can i have a pax0r3t of hoover bags for my goblin solo" and i'm like here, three pounds fifty, and they pull out this *huge* fat wallet stuffed w/20s and 50s to pay!! this happens a lot. i'd NEVER carry such amounts ov ca$h w/me, but lots of people do.
